Abstract

L'attrait qu'exercent les œuvres d'art sur les voleurs peut, de prime abord, surprendre. Le vol d'œuvres d'art connaît cependant un développement important. Afin de le comprendre, les causes de l'engouement dont les œuvres d'art sont l'objet ainsi que les différents protagonistes du marché de l'art seront évoqués. Le vol d'œuvres d'art sera d'abord analysé d'un point de vue quantitatif à travers les statistiques. Il s'agira ensuite de comprendre les raisons qui poussent une personne à voler une œuvre d'art et, suivant une perspective historique, d'envisager les développements que le vol d'œuvres d'art a connus. Les récits de vie de différents voleurs nous feront connaître leur univers et leur " métier ". Toutefois, les voleurs ne seraient rien s'ils n'avaient la possibilité d'écouler leur marchandise. Le rôle du receleur nous permettra donc de découvrir les différents réseaux de distribution des objets volés. On examinera enfin la position qu'occupe le vol d'œuvres d'art par rapport aux autres formes de criminalité. Celles-ci sont principalement le trafic de drogues, le trafic d'armes et le blanchiment d'argent.

Abstract

The issue of returning art and cultural property removed from explored or conquered lands by Americans and Europeans is an unresolved problem. This book is about the return, or not, of works of art and antiquity taken during the Age of Imperialism and now held in museums and private collections. Arguments put forth by the states seeking return or restitution for lost art treasures and meaningful cultural icons are pitted against conservator interests who maintain that these art treasures and cultural artifacts belong to all humanity and should be preserved in museums. In this volume, scholars and authorities on art, cultural property law and museum collections offer contrasting views on topics such as the Elgin Marbles, the return of the Nefertiti Bust and the problems and progress of the Native American Graves Protection and Repatriation Act (NAGPRA).

Abstract

The international controversy over who "owns" antiquities has pitted museums against archaeologists and source countries where ancient artifacts are found. In his book Who Owns Antiquity?, James Cuno argued that antiquities are the cultural property of humankind, not of the countries that lay exclusive claim to them. Now in Whose Culture?, Cuno assembles preeminent museum directors, curators, and scholars to explain for themselves what's at stake in this struggle--and why the museums' critics couldn't be more wrong. Source countries and archaeologists favor tough cultural property laws restricting the export of antiquities, have fought for the return of artifacts from museums worldwide, and claim the acquisition of undocumented antiquities encourages looting of archaeological sites. In Whose Culture?, leading figures from universities and museums in the United States and Britain argue that modern nation-states have at best a dubious connection with the ancient cultures they claim to represent, and that archaeology has been misused by nationalistic identity politics.
